Coaching Contract

This agreement between the Coach and Coaching Counterpart provides the personal commitment of each party towards the success of the coaching engagement.

The Relationship

In agreeing to a coaching relationship, the Coach and the Coaching Counterpart understand that coaching:

  • Is a structured conversation with a measurable outcome that requires a collaborative approach between the Coach and Coaching Counterpart.

  • May address work performance, skill levels, well-being aspects and general conditions in the Coaching

  • Counterpart’s profession or life as they impact on workplace performance.

  • Will not address needs requiring counseling or therapy such as mental health issues. The Coaching Counterpart may be referred to other support services if appropriate.

  • Is not a solution to all needs and there may be situations, other than those mentioned above, where coaching is not appropriate. This will be discussed between Coach and Coaching Counterpart.

Coach Commitments

Throughout the working relationship the Coach will:

  • Maintain confidentiality and adhere to ethical guidelines (see confidentiality and ethics).

  • Provide a learning environment for the Counterpart which is high in trust and challenges them to think differently and act on it.

  • Engage in direct and personal conversations either face-to-face, by phone or virtual technology as agreed between the parties.

  • Determine with the Coaching Counterpart the most useful and desired outcomes.

  • Apply contemporary coaching practices and take an evidence based approach.

  • Take a whole systems approach, partnering with the organization to ensure all required support is provided to the Coaching Counterpart and stakeholder input is obtained where appropriate or necessary.

  • Seek feedback and review coaching outcomes achieved against the goals set.

Counterpart Commitments

Throughout the working relationship the Coaching Counterpart will:

  • Demonstrate a willingness to be actively involved and committed to coaching.

  • Participate with an open mind and a readiness to move forward.

  • Come prepared and on-time to all coaching sessions with interim activities completed.

  • Set, with the Coach, interim activities to be carried out between coaching sessions, and action these in order to obtain the full benefit from coaching.

  • Give permission to the Coach to challenge thinking and behavior during the coaching sessions in support of development goals.

  • Take notes and record actions


Confidentiality and Ethics

  • Any information discussed or issues raised during coaching will be kept strictly confidential.

  • The Coach may maintain minimal notes for the sole purpose of supporting the coaching. They will ensure complete confidentiality of this information, except in rare circumstances where decreed by law or as agreed with the Coaching Counterpart for a specified purpose.

  • The Coach will ensure coaching notes are either destroyed on completion or stored securely.

  • The Coach commits to abiding by the Code of Ethics designated by the International Coach Federation.

  • The Coach may record the Coaching Counterpart’s name and contact details for the purpose of a coaching log which is required for International Coach Federation Credentials.

Coaching will be conducted virtually through Zoom or google meet.

Scheduling

Client(s) must choose a regular time and day for the weekly coaching sessions. This eliminates unnecessary decision-making, which could free up mental energy for more important things. Please email natalie@nottoocrazy.com for call time options.

Cancellation Policy

Sessions may be rescheduled with 24 hours advance notice. Monthly sessions must be made up within one week of the original session date. Weekly sessions can be appended to the end of the coaching term.

Standard Terms & Conditions


Terms for termination:
Due to your purchase being a coaching package in a business capacity, we do not offer refunds or cancellations. All contracts and purchases are binding.

We stand by the quality of the coaching provided. If there is any dispute to this, please bring this up with your coach during a session or by emailing natalie@nottoocrazy.com.

Confidentiality:

Any specific information discussed or issues raised during the course of coaching will be on a strictly confidential basis, and will not be communicated in any way with persons outside the coaching relationship. Natalie will work within the professional ethics guidelines designated by the International Coaching Federation. Copies of ethical guidelines are available on request. A 'Coaching Agreement' will be signed at the commencement of the Coaching Program.

Ownership:

The Works are the proprietary and licensed property of Not Too Crazy and are protected by copyright, trademark, and other intellectual property laws, both domestic and international. Nothing in this Agreement shall be construed as transferring, assigning, licensing, or conveying any such ownership or proprietary rights to the Works from Not Too Crazy to the Client(s) or any other person or entity. The Client(s) may not remove, alter, or obscure any copyright, legal or proprietary notices in or on any portions of the Works. The Client(s) may not duplicate, modify, or otherwise use the Works in any other format unless otherwise noted in the Program materials or Client(s) Resources without the prior written consent of Not Too Crazy.

Client(s) understand and agree that all recordings, materials, and assets given during the coaching Program are the exclusive rights of Not Too Crazy. Not Too Crazy owns all rights to any content such as audio, video, and/or photographs captured during the coaching program. Client(s) are not permitted, under any circumstances, to film, record, or capture audio or video footage or screen recordings during the coaching sessions. Any video or audio recordings shared with or given to the Client(s) are to be used and viewed only by the Client(s) and are not permitted to be shared, distributed, or reposted in any way. Client(s) who violate this may be asked to delete the footage and/or may be removed from the Program without refund.

Use of Information:

Not Too Crazy provides general personal development programming for educational use only and by law does not and cannot offer professional legal, financial, health, tax, therapeutic, or psychiatric advice or treatment. The information contained in or made available through the Program cannot replace or substitute for the services of trained professionals in any field, including, but not limited to, financial, medical, psychological, or legal matters.

Not Too Crazy makes no representations or warranties concerning any treatment, action, or application of medication, supplementation, or health advice by any person following the information offered or provided within or through the Program. Client(s) are responsible and accountable for his or her decisions, actions, and results in life, and, by his or her participation in the Program, Client(s) agree not to attempt to hold Not Too Crazy, Natalie Pan, or related brand, affiliate, or business liable for any such decisions, actions, or results, at any time, under any circumstance.

Earnings Disclaimer & Guarantees:

Not Too Crazy has taken every effort to ensure accurate representation of the Program and its ability to improve people’s lives. However, there is no guarantee that the Client(s) will obtain any specific results or earn any money using any of the ideas, tools, strategies, recommendations, or Works of the Program, and Not Too Crazy does not support any "get rich schemes" in this Program. Nothing in the Program is a promise or guarantee of results or future earnings, and neither the Program nor Not Too Crazy offers any legal, medical, tax, financial, or other professional advice. Any financial numbers referenced in the Program or associated Works are illustrative of concepts only and should not be considered average earnings, exact earnings, or promises for actual or future performance.

Making decisions based on any information presented in this Program or any Not Too Crazy products, events, services, or websites should be done only with the knowledge that the Client(s) could experience risk or losses just like any entrepreneurial or career endeavor.

Prior History:

Client(s) agree not to suffer from any physical or mental disability that might affect participation in the coaching program. If there is any substance abuse or mental illness in the past, you will have consulted a healthcare professional and advised you can participate in the coaching process without risk. If there is any change in this representation, you will promptly advise Not Too Crazy in writing to natalie@nottoocrazy.com.

Term of Agreement:

The term of this Agreement will begin upon the date Client(s) signs this Agreement (hereafter “Beginning Date”) and is effective for twelve (12) months. However, the “Use Of Information”, “Confidentiality”, and “Ownership” portions of this contract are binding indefinitely.

Dispute Resolution:

If a dispute arises out of this Agreement that cannot be resolved by mutual consent, the Client(s) and Not Too Crazy agree to attempt to mediate in good faith for up to 30 days after notice. If the dispute is not so resolved, and in the event of legal action, the prevailing party shall be entitled to recover attorney’s fees and court costs from the other party.

Waiver:

The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement.

Severability:

If any provision or covenant, or part thereof, of this Agreement, should be held by any court or other legitimate tribunal with appropriate jurisdiction to be invalid, illegal or unenforceable, either in whole or in part, such invalidity, illegality or unenforceability shall not affect the validity, legality or enforceability of the remaining provisions or covenants, or any part thereof, of this Agreement, all of which shall remain in full force and effect.
